What are the main sources of law that govern and regulate contracts for the design or carrying out of building works?

The main source of law is the Hungarian Civil Code (Act V of 2013) which contains the general provisions regulating contracts for the design and carrying out of building works (and contracts in general). As a main rule, these provisions are permissive, so the parties (such as the employer, contractor etc) are free to deviate from the rules contained in the Civil Code.

There are several other statutes directly governing and regulating construction in detail. The most important of these include the Hungarian Architecture Act (Act C of 2023), Government Decrees Nos. 191/2009, 194/2009, 280/2024, 281/2024, 266/2013 and 143/2018.

Effective as of 1 January 2025, the previously effective regulation on urban planning and building requirements (Government Decree 253/1997 (XII.20)) was replaced by a new government decree (280/2024 (IX.30)). Although most of the provisions of the new decree became applicable in July 2025, certain procedures initiated before 1 July 2025 will remain subject to the previously applicable decree. The primary scope of the government decree has not changed, it covers land development and specifies detailed rules for the construction, conversion, extension, renovation, restoration, and demolition of buildings.1
