Seller's warranties

What seller's warranties are provided under statute in the sale of real estate in this country (for example, as to the state of the building, asbestos etc)?

No warranties are given by law and warranties related to the state and condition of the building are very rare.

Since warranties are not compulsory, they can be varied to suit the parties involved in the transaction.

The Residential Properties (First-hand Sales) Ordinance (Cap. 621 of the Laws of Hong Kong) specified some statutory warranties required in agreements for first-hand sales of residential properties. Examples include that the fittings, finishes and appliances set out in the agreement will be incorporated into the property; the property will be as shown on the plan attached to the agreement; and that the communal (and recreational) facilities set out in the agreement will be provided.
