Due diligence

Do buyers usually carry out due diligence?

New Zealand

New Zealand

Yes, it is always advised that buyers undertake their own due diligence. This commonly includes reviewing the:

  • Title and any registered interests
  • Any leases, licences, or tenancies
  • Ability to insure or adequately insure the land
  • The Land Information Memorandum report (commonly called a LIM) issued by the relevant authority. The LIM summarises any recorded issues with contamination, building consents, enforcement actions against the seller or the land, issues with the building and other records such as special land features, hazards, and utilities.
  • Relevant planning and zoning rules

This is usually carried out by the buyer’s lawyer. The buyer can also request on-site inspections and tests including building and geotechnical reports, seismic assessments, asbestos assessments, methamphetamine drug contamination/toxicology reports, and valuations. The extent of investigation will depend on the nature and intended use of the real estate and/or the complexity of the target property.
